DMCA Policy

MindCast is a concept explainer platform that generates educational audio content from publicly available information. We do not host, summarize, or reproduce copyrighted books, articles, or other protected works in their entirety. Our AI pipeline synthesizes knowledge from general public information to create original educational narratives.

1. Overview

MindCast respects intellectual property rights and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), codified at 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the MindCast platform that are reported to our designated copyright agent.

If you are a copyright owner, or authorized to act on behalf of one, and you believe that copyrighted material has been copied or used in a way that constitutes copyright infringement, please submit your claim via the process described below.

2. How to File a DMCA Takedown Notice

To file a DMCA takedown notice, you must provide a written communication that includes the following information, as required by 17 U.S.C. § 512(c)(3):

Your DMCA takedown notice must contain all of the following:

  1. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notice, you may provide a representative list.
  2. Identification of the infringing material — The specific URL(s) or other information sufficient for us to locate the material on MindCast that you claim is infringing. Please be as specific as possible (e.g., the episode URL at mindcast.fm).
  3. Your contact information — Your name, mailing address, telephone number, and email address so that we may contact you regarding your complaint.
  4. Statement of good faith belief — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy under penalty of perjury — A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or electronic signature — A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

4. Counter-Notification

If you believe that material you posted on MindCast was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include:

  1. Identification of removed material — Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or access was disabled.
  2. Statement under penalty of perjury — A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  3. Your contact information — Your name, address, and telephone number.
  4. Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which MindCast may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Physical or electronic signature — Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the party who filed the original takedown notice. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within 10 business days, we will restore the removed material.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, MindCast has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

7. Misrepresentation Warning

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees. If you are unsure whether material on MindCast infringes your copyright, we recommend consulting an attorney before filing a DMCA notice.
